“The I.I.I. vigorously contested a Consumer Federation of America (CFA) study which asserted that insurance rating practices were driving up auto insurance prices for low- and moderate-income households.

The I.I.I. pointed out that the CFA analysis came only weeks after another organization—the National Association of Insurance Commissioners (NAIC)—representing the nation’s insurance commissioners found that the typical U.S. motorist had seen his or her auto insurance expenditures drop every year between 2005 and 2009.

“Auto insurance provides important, cost-effective financial protection to millions of Americans, and most drivers have dozens of auto insurers constantly competing for their business,” said Dr. Robert Hartwig, CPCU, president of the I.I.I. and an economist.

The NAIC determined that drivers paid $785, on average, to insure a private-passenger vehicle in the U.S. in 2009, four dollars less than in 2008. The downward trend, which involved the purchase of a policy that included liability as well as optional comprehensive and collision coverages, began in 2005 ($832 per vehicle, per year), and continued into 2006 ($817), 2007 ($797), and 2008 ($789). The NAIC report was released publicly on January 17, 2012, and is the association’s most recent assessment of the U.S. auto insurance marketplace.

Citing other signs of a healthy insurance marketplace, the I.I.I. noted that the percentage of median family income spent on auto insurance has dropped sharply in recent years, as has the percentage of drivers who pay more for their auto insurance coverage through their state’s assigned-risk pools, also known as the residual market.

The ratio of auto insurance costs to family income, an index developed by Risk Information, Inc., publisher of Auto Insurance Report, dropped from 1.27 percent in 2004 to 1.05 percent in 2009, the most recent year for which this data is available. In addition, between 1994 and 2004, the percentage of drivers participating in residual markets declined from about 4 percent to 1.6 percent, a statistic cited in the CFA study. But the CFA did not note that the latter statistic meant these drivers would be paying less for auto insurance when they left their state’s assigned-risk pools, where the riskiest drivers congregate, and re-entered the so-called voluntary market.

State-sponsored efforts to provide income-eligible persons with liability insurance protection at affordable rates have not gained a significant following. California’s state-sponsored Low Cost Automobile Insurance Program (CLCA), for instance, had fewer than 12,000 policies in effect as of year-end 2011 even though the state is home to more than 30 million people. The CLCA was created in 1999 but the private-sector appears to have been able to meet the CLCA’s public policy goal more effectively, according to Dr. Hartwig.

“The most effective way to lower the price of auto insurance is reduce the costs of underlying factors, such as the cost of medical care and auto repair as well the impact of insurance fraud ,which levies a tax on drivers, particularly in states like Florida, Michigan, New Jersey and New York,” Dr. Hartwig said. “Changing rating factors that have been shown to accurately project future losses will only distort prices and result in good drivers subsidizing riskier ones.”

Dr. Hartwig explained that auto insurance policyholders also have a degree of control over the price they pay for insurance coverage because the premium is determined in part by their driving record, the type of car they drive, and the type and amount of coverage they purchase. Moreover, state insurance regulators already review and approve the various rating criteria (e.g., a driver’s age, gender and miles driven each year) auto insurers are allowed to employ when pricing a prospective or current policyholder’s policy.

“As anyone who watches television commercials knows, auto insurance coverage is widely available in every U.S. state,” said Dr. Hartwig. “And competitive marketplaces drive down prices. Car owners have a multitude of choices when it comes to buying coverage as well as a variety of ways to obtain it: through an agent, over the phone or online. Drivers should shop around if they feel as though their current auto insurer is not meeting their needs, or charging too high a price,” he added.

“The other thing U.S. vehicle owners should keep in mind is that property/casualty insurers, unlike some other sectors of the financial services industry, remain financially strong. Auto insurers not only recruited new policyholders and renewed existing ones but also paid claims and offered new products and services throughout the most severe economic downturn since the Great Depression,” Dr. Hartwig concluded.

Los Angeles Superior Court Commissioner Douglas Carnahan ruled Wednesday that the automaker misled Heather Peters about the potential fuel economy of her hybrid car and awarded her $9,867 – much more than the couple hundred dollars cash that a proposed class-action settlement is offering.

“At a bare minimum Honda was aware … that by the time Peters bought her car there were problems with its living up to its advertised mileage,” Carnahan wrote in the judgment.

Honda disagrees with the judgment rendered in the case and plans to appeal the decision, company spokesman Chris Martin said in a statement.

Peters, a former lawyer, said she is renewing her legal license after a 10-year lapse so she can represent other Honda owners who have the same problems she did.

“Wow! Fantastic. I am absolutely thrilled,” she said when The Associated Press informed her of the judge’s decision. “Sometimes big justice comes in small packages. This is a victory for Honda Civic owners everywhere.”

Carnahan included in his 26-page decision a long list of misleading representations by Honda that he said Peters had correctly identified. Among them were that the car would use “amazingly little fuel,” “provides plenty of horsepower while still sipping fuel,” and that it would “save plenty of money on fuel with up to 50 mpg during city driving.”

“Actual performance of plaintiff’s vehicle did not live up to these standards,” he said. He noted that when she began receiving much less than the advertised mileage, “she knew she had a problem.”

Peters opted out of the class-action lawsuit so she could try to claim a larger damage award for her 2006 Honda Civic’s failure to deliver the 50 mpg that was promised.

The proposed class-action settlement would give aggrieved owners $100 to $200 each and a $1,000 credit toward the purchase of a new car. Legal fees in the class action would give trial lawyers $8.5 million, Peters said.

In small claims court, there are no attorneys’ fees and cases are decided quickly.

Peters had hoped to inspire a flood of small-claims lawsuits by the other 200,000 people whose Honda Civic hybrids are covered by the proposed settlement. If all 200,000 owners sued and won in small claims court, she said, it could cost Honda Motor Co. $2 billion.

Peters launched a website, DontSettleWithHonda.org, and said she was contacted by hundreds of other car owners seeking guidance on filing small claims lawsuits if they opted out of the class-action case. But legal experts say it’s unlikely that many owners would take the small-claims route because of the time and energy involved in pursuing such lawsuits.

Carnahan found that Honda did commit fraud, but he could not find intentional fraud and thus did not award punitive damages. Most of the damages Peters was awarded were for extra money spent on fuel, both in the past and future, the cost of the car battery, and the decrease in the car’s value because of its problems.

A judge in San Diego County is due to rule in March on whether to approve Honda’s class-action settlement. Members of the class have until Feb. 11 to accept or decline the deal.

In a recent survey of 1,000 U.S. drivers by Allstate Insurance, 64 percent of respondents rated themselves as either “excellent” or “very good” drivers. But that confidence in driving ability doesn’t extend far; the respondents said that only 29 percent of their close friends and only 22 percent of people their own age deserved an excellent or very good rating.

The Allstate survey found some significant differences in responses among various groups. For example, while 36 percent of the men surveyed gave themselves an excellent rating, only 26 percent of the women thought they deserved that designation. Thirty-five percent of college-educated drivers considered themselves excellent drivers, while only 28 percent of those without degrees claimed that distinction.

Respondents were in agreement, however, about who doesn’t drive well. Their biggest criticism was saved for teenage drivers; four of every five respondents said teens either were “average” or “poor” drivers. Seventy percent gave senior drivers  poor scores. Parents driving with children were rated average or poor drivers by 33 percent of those surveyed; only 26 percent of respondents declared that those parents were good drivers.

Those surveyed also don’t seem to trust their neighbors on the road. Drivers from adjacent states earned ratings of “average” or “poor” from 53 percent of respondents; only 8 percent considered drivers in neighboring states to be “excellent” or “very good.”

In other words, according to the survey, many Americans consider themselves to be good drivers — and nearly everyone else to be maniacs on the road.  But even drivers who gave themselves the highest scores acknowledge dangerous behind-the-wheel behavior that was inconsistent with their self-assessments.

More than 70 percent of survey respondents, for example, acknowledged they’ve either caused or almost caused an accident because they were distracted while driving. For young drivers, texting is particularly distracting; 63 percent of drivers ages 18 to 29, and 58 percent of those between 30 and 44 said they have sent text messages while driving.

Almost nine out of 10 surveyed drivers admitted speeding, and 20 percent said they’ve exceeded the posted limits by more than 20 miles per hour. Almost half said they’ve been guilty of driving while tired — and have almost fallen asleep at the wheel. Nearly one-fourth of the men responding (23 percent) confessed to driving while intoxicated. Meanwhile, only 6 percent of women said they’ve driven while under the influence.

It’s perhaps not surprising, then, that more than half (58 percent) of the surveyed drivers said they’ve had an accident, but only 28 percent acknowledge the accident was their fault.

The drivers surveyed — and all drivers who allow their attention to wander when they’re behind the wheel — might do well to ponder some statistics from the federal Centers for Disease Control and Prevention. According to the CDC, more than 15 people are killed and more than 1,200 people are injured every day in the United States in crashes that involve distracted driving. So until drivers learn to stay off their cellphones, put down their travel mugs and refrain from snacking while behind the wheel, it’s questionable whether they actually deserve those high ratings that they give themselves.
