In the same loss situation above, if the at-fault driver had a $50,000 liability limit and the not at-fault driver had a $50,000 uninsured motorist limit, the not at-fault driver would not be entitled to any payment under his/her uninsured motorist coverage.
At-fault driver = $50,000 Liability Payment
Not at-fault driver = $50,000 UM Limit
Payment due from UM Coverage = $50,000 – $50,000 = 0
Beginning January 1, 2009 insureds will be able to get the benefit up to their full uninsured motorist limit when an at-fault uninsured/underinsured motorist is responsible for damages. The change simply means that the full amount of selected uninsured motorist limits can be used as an additional limit of coverage, without offset, from the liability limit of the underinsured at-fault motorist. For the examples above the formulas would change as follows:
At-fault driver = $50,000 Liability Payment
Not at-fault driver = $100,000 UM Limit
Payment due from UM Coverage = $100,000

Beginning January 1, 2009 the Uninsured Motorist statute expressly allows an insurer to “exclude”[offset] personal or bodily injury or death payments for which the insured has been compensated “pursuant to medical payments or workers’ compensation laws.”

You need to do this because new auto insurance requirements were approved by the Democratic-controlled Legislature earlier this year. The minimum limits for car insurance and also the auto insurance premiums are increasing with effect from 1st November 2009.
As insurance companies begin mailing notices to Wisconsin customers telling them that their premiums are likely to increase soon, state politicians are scrambling to Assembly Majority Leader Tom Nelson, D-Kaukauna, said in an Oct. 7 letter to a constituent who inquired about higher premiums that “any premium increases are due to the business decisions of insurance providers rather than any action taken by the Legislature.”
However, premiums in general are expected to go up for consumers who purchased only the minimum limits because of the changes, said OCI spokesman Jim Guidry.
Determining how much, or what the impact would be on an individual policy holder, is difficult because some consumers purchased more than the minimum limits, Guidry said. Also, there are more than 200 insurance companies competing with one another and a variety of other factors, including driving record and past claims experience, affect premiums, he said.
“People who have higher limits that are at or higher than the new mandated amounts, will not be impacted,” said Ken Muth, a spokesman for American Family Insurance, which is based in Madison. “It’s going to depend on what the coverages are now and the additional coverages you’ll have to take on. … It may go up significantly for some.”

In Texas in a particular case when a person was injured due to an uninsured motorist, he was allowed to use both the limits of his policy for the same. Thus as per the gist of the judgment given below :
“The Texas statute does not speak specifically to the stacking issue, but, as evidenced in the caselaw, the courts have expressed a clear understanding that the purpose of the statute is that insureds recover for their actual damages and that a policy provision preventing full recovery conflicts with that public policy and is thus invalid. Therefore, it appears that in Texas, the “two or more auto policies” provision, when coupled with the intent and purpose of the uninsured motorist statute, will not operate to prevent stacking where the insured has two policies with an insurer and their actual damages are greater than the maximum recovery under one policy’s uninsured/underinsured motorist coverage.

The stacking and anti-stacking of the policies would depend from state to state and the provisions and whether there has been a case decided in the same lines in the state.
